Terms of sale and use
In case of discrepancy, the French version prevails.
Version of October 11, 2026. In force from October 11, 2026.
1. Purpose
These terms govern access to and use of the Supercalcula API service (the “Service”), published by Impulse Orbite (Alexandre Gertsch, sole proprietorship), Le Grand-Saconnex, Switzerland (the “Publisher”). Through programming interfaces (APIs), the Service provides automated data-processing functions described in the documentation available on supercalcula.ch.
2. Account and access keys
2.1 Using the Service requires an account with a valid email address. The customer is responsible for the confidentiality of their credentials and API keys, and for any use made with them. 2.2 The customer undertakes to revoke any compromised key without delay and to inform the Publisher of any unauthorised use. 2.3 The Service is intended for professionals and adult individuals. An account is personal; a company may create an account in the name of its organisation.
3. Plans, prices and payment
3.1 The Service offers a free plan (“Free”) limited in volume, monthly subscriptions (“Starter”, “Pro”) and one-off credit packs. Quotas, rate limits and prices are those shown on the Pricing page at the time of the order. 3.2 Prices are shown in Swiss francs (CHF) or euros (EUR), excluding taxes. The Publisher is not currently subject to Swiss VAT; if this changes, the applicable VAT will be added to the prices and shown on the invoice. 3.3 Payment is made through Stripe. The subscription is billed in advance for each period. An invoice is issued for each payment and is available in the customer area. 3.4 Purchased credits have no expiry date as long as the account exists. They are neither refundable nor transferable. 3.5 The Publisher may change its prices. Any change is announced by email at least 30 days before it applies to current subscriptions; the customer may cancel before that date.
4. Term, plan changes and cancellation
4.1 Subscriptions are concluded for one month (or one year for annual plans) and renew automatically. 4.2 The customer may change plan at any time; the difference is prorated by the payment provider. 4.3 The customer may cancel at any time from the customer area. Cancellation takes effect at the end of the current period; no period that has started is refunded. The account then returns to the Free plan. 4.4 If a failed payment is not settled within 7 days, the subscription is suspended and then terminated, and the account returns to the Free plan.
5. Permitted and prohibited use
5.1 The customer uses the Service in compliance with applicable law and third-party rights. 5.2 In particular, the following are prohibited: sending unlawful content; using the Service for spam, harassment, non-consensual address harvesting or extracting content from websites that forbid it; any attempt to circumvent quotas, rate limits or the Service's security; reselling the Service without written agreement. 5.3 The Publisher may suspend or terminate an account in case of breach, after notification by email except in urgent cases.
6. Availability and support
6.1 The Publisher strives to provide high availability of the Service, without any contractual service-level guarantee. Interruptions for maintenance may occur; they are announced on the Status page where possible. 6.2 Support is provided by email (contact@supercalcula.ch) on business days, in French, German or English. 6.3 The results produced by the Service (email validation, analyses, conversions) are provided for guidance, based on public data or algorithms; the customer remains responsible for how they are used.
7. Data
7.1 The content of requests sent to the Service is processed in memory and is not kept after the response. Only technical metadata (date, endpoint, status, duration, size) is logged for 90 days. 7.2 The customer warrants that they hold the rights and authorisations required for the data they submit, including, where applicable, under the data protection laws that apply to the individuals concerned. 7.3 The processing of the customer's personal data is described in the privacy policy.
8. Liability
8.1 To the extent permitted by Swiss law, the Publisher's liability is limited to direct damages and capped at the amount paid by the customer over the previous twelve months. The Publisher is not liable for indirect damages, data loss, loss of profit or business interruption. 8.2 This limitation does not apply in case of gross negligence or wilful misconduct.
9. Changes to the Service and the terms
The Publisher may change the Service (adding, modifying or withdrawing APIs) and these terms. Material changes are notified by email 30 days in advance; use of the Service after that date constitutes acceptance. The withdrawal of an API is announced at least 90 days in advance.
10. Governing law and jurisdiction
These terms are governed by Swiss law. Any dispute falls under the courts of the canton of Geneva, subject to mandatory provisions protecting consumers.
